1. Introduction

This Privacy Notice explains how Namarc Technology ("Namarc Events", "we", "us") collects, uses, shares, and protects personal data when you use the Namarc Events dashboard and messaging services, and when your contacts receive messages sent through your Account ("Recipients"). It should be read together with our Terms & Conditions.

2. Who we are

Namarc Technology is the data controller responsible for personal data processed through the Namarc Events dashboard itself (your Account details and how you use the Service). For messages you send through the Service, you — the Client — act as the data controller for the Recipient data you upload or enter (such as phone numbers, names, and event guest details), and Namarc Technology acts as a data processor on your behalf, alongside the gateway providers described below.

3. Data we collect

  • Account data — name, email address, phone number, business details, and login credentials you provide when registering.
  • Recipient data — phone numbers, names, and any other contact or guest details you upload to send SMS, WhatsApp messages, OTPs, or event invitations.
  • Message content — the text and metadata of messages you send and, where applicable, delivery and read status reported back by the gateway provider.
  • Payment data — billing details and transaction records associated with your Account; we do not store full card numbers, which are handled directly by our payment processors.
  • Usage & log data — how you interact with the dashboard, API request logs, IP addresses, device/browser information, and audit logs of actions taken on your Account.
  • Cookies — small files stored in your browser to keep you signed in and remember preferences (see Section 11).

4. How we use your data

  • To create and administer your Account and provide the Service you request;
  • To transmit the SMS, WhatsApp, and OTP messages you send, and to process event RSVPs and QR check‑ins;
  • To bill and collect payment for the Service;
  • To monitor, secure, and improve the Service, including detecting fraud or abuse;
  • To communicate with you about your Account, service updates, or support requests; and
  • To comply with legal obligations, including those of telecom regulators.

5. Legal basis for processing

We process personal data on the basis of performing our contract with you (delivering the Service you signed up for), our legitimate interests (securing and improving the Service, preventing fraud), compliance with legal obligations, and, where applicable, your consent — for example, the consent you must obtain from Recipients before sending them marketing messages.

6. How we share data

We share personal data only where necessary to provide the Service:

  • Messaging gateway providers — NextSMS and Infobip for SMS delivery, and Meta (via the WhatsApp Business Platform / Cloud API) for WhatsApp delivery — receive Recipient phone numbers and message content solely to deliver your messages.
  • Payment processors — to process payments and collections on your Account.
  • Service providers — hosting, infrastructure, and analytics providers that support the Service under contractual confidentiality obligations.
  • Legal & regulatory bodies — where required to comply with applicable law, a court order, or a lawful request from a telecom or data protection regulator.

We do not sell personal data to third parties.

7. International data transfers

Because some of our gateway providers — including Meta's WhatsApp Business Platform — operate and process data outside of Tanzania, personal data may be transferred to and processed in other countries. Where this occurs, we rely on the data protection safeguards those providers have in place and take reasonable steps to ensure data transferred internationally continues to receive an appropriate level of protection.

8. Data retention

We retain Account data for as long as your Account is active and for a reasonable period afterward to meet legal, accounting, or dispute‑resolution requirements. Message logs and delivery records are retained for as long as needed for billing verification, troubleshooting, and any regulatory retention requirement, after which they are deleted or anonymized.

9. Data security

We use technical and organizational measures — including encryption of sensitive credentials at rest, access controls, and audit logging of administrative actions — to protect personal data against unauthorized access, alteration, or loss. No system is completely secure, and we encourage you to also protect your own Account credentials.

10. Your rights

Subject to Tanzania's Personal Data Protection Act, 2022 and its implementing regulations, you may have the right to access, correct, delete, or restrict the processing of your personal data, and to object to certain processing or request data portability. To exercise these rights, contact us using the details in Section 14; we may need to verify your identity before acting on a request. If you are not satisfied with our response, you may lodge a complaint with Tanzania's Personal Data Protection Commission.

11. Cookies

We use essential cookies to keep you signed in to the dashboard and to protect against cross‑site request forgery, and may use limited analytics cookies to understand how the Service is used. You can control cookies through your browser settings, though disabling essential cookies may prevent you from logging in.

12. Children's privacy

The Service is intended for business and organizational use by adults. We do not knowingly collect Account data from children. Event or guest data uploaded by a Client may relate to minors (for example, event guests); Clients are responsible for having appropriate consent to include such data.

13. Changes to this notice

We may update this Privacy Notice from time to time to reflect changes in the Service or applicable law. Material changes will be communicated by email or an in‑dashboard notice before they take effect.
